Acceptable Use Policy

Introduction
This Acceptable Use Policy ("AUP") outlines the appropriate and permitted usage of MsgOrb's services, including our WhatsApp messaging automation and international calling functionality. To ensure the integrity of our network, protect our users, and comply with third-party gateway agreements (such as Meta and telecommunication partners), all users must adhere to this policy.
Prohibited Activities
You agree not to use, and not to encourage or allow any end user to use, MsgOrb services in the following prohibited ways:
- Unsolicited Messages (Spam): Sending unsolicited commercial messages or robocalls. You must obtain explicit opt-in consent from recipients before messaging or calling them.
- Illegal Content or Activity: Transmitting material that is illegal, defamatory, libelous, harassing, or fraudulent.
- Harmful Content: Distributing malware, viruses, trojans, phishing links, or engaging in any activity that damages or disrupts our infrastructure or any third-party infrastructure.
- Impersonation: Spoofing caller IDs, falsifying sender information, or impersonating any person or entity without legal authorization.
- High-Risk Activities: Using the platform for emergency services routing (e.g., 911), or any other environment where failure could lead to death, personal injury, or environmental damage.
- Bypassing Limits: Creating multiple accounts to circumvent rate limits, billing, or suspension blocks.
Consent and Compliance (TCPA & GDPR)
It is your exclusive responsibility to comply with all applicable telemarketing laws, including the Telephone Consumer Protection Act (TCPA) in the US, the General Data Protection Regulation (GDPR) in the EU, and equivalent laws globally. You must always:
- Acquire and maintain records of verifiable opt-in consent for every contact.
- Provide clear, working opt-out mechanisms (e.g., standard "STOP" commands) and honor them immediately.
- Honor national and global "Do Not Call" registries.
WhatsApp-Specific Restrictions
All WhatsApp communications powered by MsgOrb must strictly adhere to the WhatsApp Commerce Policy and the WhatsApp Business Policy. Violations of Meta's rules will result in immediate disqualification of your WhatsApp Business Account.
Enforcement
We actively monitor our platform for abuse to ensure high deliverability and service quality. If we determine, in our sole discretion, that you have violated this AUP, we may take immediate action, including but not limited to:
- Issuing a warning.
- Temporarily suspending your access to the services without prior notice.
- Permanently terminating your account.
- Reporting suspected illegal activities to law enforcement agencies and cooperating with their investigations.
No refunds will be provided for accounts terminated due to AUP violations.
Reporting Abuse
If you believe someone is using MsgOrb to send spam or abusive content, please immediately report the incident, including headers or screenshots if possible, to abuse@msgorb.com or support@msgorb.com.
