Acceptance of Terms

By accessing or using MsgOrb's WhatsApp automation Software as a Service (SaaS) platform and international calling services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access our services.

Description of Service

MsgOrb provides an online platform that enables businesses to automate WhatsApp messaging and make international voice calls. The platform integrates with third-party providers including Meta (WhatsApp Business API) and telecommunications carriers. You acknowledge that our services depend on the availability and terms of these third-party integrations.

Account Registration and Security

To use our services, you must register for an account. You agree to provide accurate and complete information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Acceptable Use

You agree not to use the Service to:

• Send unsolicited messages or "spam" via WhatsApp or SMS.
• Transmit any content that is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable.
• Violate any third party's intellectual property rights or rights to privacy.
• Use the API to circumvent Meta's WhatsApp commerce policy or messaging limitations.
• Engage in fraudulent activities, including impersonating another person or entity.

Payment and Billing

Our services are billed on a subscription and usage basis. By providing payment information, you authorize us to charge your payment method for all applicable fees. Fees are non-refundable unless otherwise required by law or detailed in our refund policy. MsgOrb uses third parties like Stripe to process payments.

Data Processing and Privacy

Your use of the Service is also governed by our Privacy Policy. By using MsgOrb, you consent to the collection and use of your information as detailed in our Privacy Policy. You also agree to comply with your obligations as a data controller regarding any customer data you upload or transmit via our platform.

Third-Party Terms

Because our services interact with Meta's WhatsApp network, your use of MsgOrb is also strictly subject to the WhatsApp Business Policy and WhatsApp Business Terms of Service. You agree to comply with all such third-party terms. We reserve the right to suspend or terminate your account if Meta determines you have violated their policies.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MsgOrb, its affiliates, directors, employees or its suppliers be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes. Your continued use of the service following the posting of any changes to these Terms constitutes acceptance of those changes.
